The Service is provided on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, availability, or suitability of the Service for any specific purpose. Features may change, be limited, or discontinued at any time without prior notice.
Disclaimer Regarding AI-Generated Content: The content generated by eSAMz AI is for informational purposes only and should not be considered professional advice. You acknowledge that AI models can produce inaccurate, incomplete, or misleading information, including phenomena commonly referred to as "hallucinations" — where the AI generates plausible-sounding but factually incorrect or fabricated content. You must independently verify all information provided by the Service, especially concerning medical, legal, financial, safety-critical, or other sensitive matters. You are responsible for ensuring that your use of AI-generated content complies with all applicable laws and does not infringe on any third-party rights.
Non-Exclusivity of Output: You acknowledge that the same or substantially similar outputs may be generated for other users of the Service, as the AI models operate on probabilistic principles. Accordingly, you should not assume that any AI-generated output is exclusive or unique to you.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF ESAMZ AI EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY, OR THE AMOUNT PAID BY YOU TO ESAMZ AI FOR THE SERVICE DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH CLAIM, WHICHEVER IS GREATER.

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in India to resolve any dispute arising out of these Terms or the Service.
EU Users: If you are a resident of the European Union, you may additionally benefit from mandatory consumer protection provisions under the laws of your EU member state of residence, including but not limited to rights under the EU AI Act, GDPR, and applicable EU consumer protection directives. Nothing in these Terms is intended to override your mandatory statutory rights as a consumer under EU law.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on our website and, for signed-in users, via the email associated with your account. What constitutes a material change will be determined at our sole discretion. eSAMz AI shall not be held liable for any failure or delay in performing its obligations under these Terms arising from or attributable to acts, events, omissions, or accidents beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, strikes or labor disputes, shortages of materials or supplies, failure of third-party providers (including AI model providers, cloud infrastructure, or authentication services), internet outages, power failures, or any other cause beyond our reasonable control.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms, and these Terms shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein. The remaining provisions of these Terms shall continue in full force and effect, and the invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the provision.
The failure of eSAMz AI to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by eSAMz AI. The waiver of any provision of these Terms on one occasion shall not be deemed a waiver of such provision on any subsequent occasion.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and eSAMz AI regarding the use of the Service, and supersede any prior agreements, understandings, or representations, whether oral or written, regarding the subject matter hereof. In the event of any conflict between these Terms and our Privacy Policy, the Privacy Policy shall prevail with respect to data protection and privacy matters, and these Terms shall prevail with respect to all other matters.
